How do I recognize plagiarism (Made in Asia)?

• Weld seam not in the groove – weld seam is on topside of the handrail
• Welding method is TIG/WIG welding, no laser weld seam
• Tarnish colors in the tube body and thus, corrosion is preprogrammed
• NO rolled-in marking of material code , manufacturer, and date of production in the groove area
• Not packed in tubular film, poor secondary packing 
• Indefinable ground finish and thus, type of grinding not selectable 
• Twist and sword-effect very strong, high tension in 2D and 3D bent parts 
• Accessories and fittings are stainless steel castings ! This material has no license for using in bulidings and needs an individual acceptance !
• The U-Section silicone profile is outside the german TRAV
  

What consequences am I facing if I use any plagiarism:
Applications subject to building authorities' approval and similar sectors:

Removal
The builder respectively the architect can insist on the removal of any building product nonconforming to applicable technical rules and regulations and/or state-of-the-art.

Nonpayment
Rightful nonpayment for construction work is possible.

Claims for damages
Costs and claims for damages may easily exceed a multiple of the tubing's selling price. That way, claim for damages is also possible regarding consequential costs.

Complaint of an offense by reason of fraud
According to the Bavarian building regulations (article 89, clause 1, No. 4, BayBO), a penalty in the amount of up to 500,000 € is possible. Individual state building regulations are following the aforesaid. § 263 StGB: According to the criminal code, unauthorized use of the - Ü - (conformity) marking is punishable and is penalized by up to 5 years of prison sentence.

Complaint of an offense by reason of bodily harm
Imaginable is also complaint of an offense by reason of bodily harm. That applies in case a user is injuring oneself at a balustrade or handrail, which is improperly manufactured or manufactured using improper materials.

Plagiarism of the DAIDALOS®
STAINLESS STEEL GROOVED-TUBE SYSTEM REC 3

Dear ladies and gentlemen,

Recently, we unfortunately had to notice that inferior plagiarisms of our DAIDALOS® Stainless Steel Grooved-Tube System REC 3 in the dimensions of 42.4 and 48.3 mm are offered on the market. The dimension 60,3 and the Ovalelliptical-Tube 80-40-2 are recreated too.

We expressly point out that in contrast to our system products, those plagiarisms are NOT permitted for use in applications subject to building authorities' approval.

Since also YOU as dealer, fabricator, or metalworker can be prosecuted if you put products for applications subject to building authorities' approval in circulation, which are not approved (see attached extract on legal consequences regarding that subject), we would expressly like to ask you to refrain from such products.

The most important distinguishing features to our system products are:

• Weld seam NOT located in the groove
• NO rolled-in marking of material code, manufacturer, and charge identification in the groove area
• NO DAIDALOS® REC 3 tubular film
